§ 23-26.6. Waiver/Modification of Development Standards.

  • (a)

    Applicants may, by submitting a letter of Justification/Explanation, seek a waiver, modification or reduction of development standards that will otherwise preclude or inhibit the use of density bonus units in a housing development at the densities or with the concessions or incentives permitted by this Article. The applicant may also request a meeting with the City to discuss such request for waiver/modification. In order to obtain a waiver/modification of development standards, the applicant shall show that (i) the waiver or modification is necessary to make the housing units economically feasible, and (ii) that the development standards will have the effect of precluding the construction of a housing development meeting the criteria of section 23-26.3(a), at the densities or with the concessions or incentives permitted by this Article.

    (b)

    Nothing in this section shall be interpreted to require the City to waive, modify or reduce development standards if the waiver, modification or reduction would have a specific adverse impact.

    (c)

    The application and review process for a waiver/modification of development standards is set forth in section 23-26.11.
